Participant Waiver, Release of Liability, and Assumption of Risk Agreement

As a condition to Grady Memorial Hospital Corporation d/b/a Grady Health System, Grady Health Foundation ("Grady") accepting my registration and allowing me to participate in Move For Grady and its related events and activities (collectively "Move For Grady"), I understand, acknowledge, represent and agree as follows:

  1. I will be at least eighteen (18) years of age by April 26, 2025.
  2. While participating in Move For Grady, I will be using public streets and facilities where many hazards exist, and I am aware of and appreciate the risks that may result including the risk of serious injury or death.
  3. The risk of injury from participation in Move For Grady is significant, including the potential for severe dehydration, permanent injury, illness, paralysis, and death, and while particular rules, safety initiatives, equipment and personal discipline may reduce this risk, the risk of serious injury or death still exists.
  4. I knowingly and freely assume all such risks, both known and unknown, associated with participating in Move For Grady, and, understanding such risks, voluntarily want to participate in Move For Grady.
  5. TO THE FULLEST EXTENT PERMITTED BY LAW, I KNOWINGLY AND FREELY ASSUME ALL RISKS RELATED TO MY PARTICIPATION IN MOVE FOR GRADY, BOTH KNOWN AND UNKNOWN AND EVEN IF SUCH RISKS ARISE FROM THE RECKLESS OR NEGLIGENT CONDUCT OF THE RELEASEES (DEFINED BELOW) OR THE INTENTIONAL, RECKLESS OR NEGLIGENT CONDUCT OF OTHERS, AND REGARDLESS OF WHETHER SUCH RISKS ARE COVERED BY MY PERSONAL HEALTH INSURANCE OR OTHER TYPES OF INSURANCE AND I ASSUME FULL RESPONSIBILITY FOR MY PARTICIPATION IN MOVE FOR GRADY.
  6. I acknowledge and agree that I am solely responsible for my personal health and safety and for the personal property I bring with me.
  7. I agree that I am physically capable of participating in Move For Grady. If I am aware of or under treatment for any physical infirmity, ailment or illness, I will obtain my medical care provider's approval to participate in Move For Grady, and I will maintain personal health insurance while participating in Move For Grady. I may be asked to provide a doctor's note or other proof that my primary health care provider has permitted me to participate in Move For Grady. I may be asked to alter or conclude my ride if in the judgment of the on-site personnel I present a safety risk to myself or others. I expressly agree that I will not participate in Move For Grady if I am aware that I have any ailment or illness that may adversely affect or cause illness or impairment to others, including if I am aware that I have been infected COVID-19 at the time of Move For Grady or exposed to COVID-19 preceding the Move For Grady event.
  8. I consent to treatment in the event of an emergency or other incident if, in the judgment of the on-site personnel, I require medical care. 
  9. At all times while participating in Move For Grady, I agree to abide by all rules and regulations established by the Move For Grady organizers, staff and support personnel as well as all traffic laws and local vehicle codes and all rules of the road for bicyclists, including but not limited to the following: 
    • Move For Grady is an outdoor, rain or shine event, held on April 26, 2025.
    • A properly fitting, DOT approved helmet must be worn at all times while riding. 
    • Obey all traffic signs, signals, laws, and rules of the road at all times. 
    • Headphones, iPods and radios are strictly prohibited while riding. 
    • Obey instructions from all law enforcement and traffic control personnel. 
    • Obey instructions from the Move For Grady staff, road crew and volunteers. 
    • Registrations are non-transferable. Any requests for changes must be submitted prior to April 14, 2025 to support@moveforgrady.com. Requests will be reviewed on a case-by-case basis and are left to the discretion of Move For Grady staff.
    • Move For Grady 2025 is a cycling, running, and walking event. For the safety of all participants, only certain bicycles are allowed on the routes. We expressly agree to only use approved bicycles during the Move For Grady event and on the routes. Click here for a complete listing of bicycles allowed and not allowed.
    • Participants under the age of 18 years old at the time of Move For Grady 2025 will be required to have the consent of their parent or legal guardian. Due to difficulty of some of the routes, some minors are discouraged from participating and/or must be accompanied by their parent or legal guardian. For a complete explanation please click here
  10. If I observe any unusual, significant hazard during Move For Grady, I will immediately bring such hazard to the attention of the nearest official. 
  11. I agree that I will not ride with an infant or child under the age of six years old in a seat attached to my bicycle or any other riding apparatus at any time during Move For Grady. 
  12. I, on behalf of myself and my heirs, assigns, personal representatives, administrators, estate and next of kin, HEREBY VOLUNTARILY, IRREVOCABLY AND FOREVER: (i) RELEASE Grady Memorial Hospital Corporation d/b/a Grady Health System, Grady Health Foundation, Georgia State University, Board of Regents of the University System of Georgia, each sponsor of Move For Grady, each funding partner of Move For Grady, each vendor providing goods or services to Move For Grady, each owner and/or lessor of any premises, property or piece of equipment used to conduct Move For Grady, each of the foregoing parties' respective affiliates, and each of the foregoing parties' respective current and former owners, partners, members, officers, directors, trustees, advisors, consultants, employees, agents, volunteers, officials, representatives, successors, assigns and other participants (collectively, "RELEASEES"), FROM ANY AND ALL LIABILITY WHATSOEVER, INCLUDING WITHOUT LIMITATION, LIABILITY FOR ANY AND ALL INJURIES, DISABILITIES, DEATH, LOSSES OR DAMAGES, INCLUDING PUNITIVE DAMAGES, TO PERSON OR PROPERTY, ARISING DIRECTLY OR INDIRECTLY IN CONNECTION WITH MY PARTICIPATION IN MOVE FOR GRADY, WHETHER OR NOT CAUSED BY ANY ACT OR OMISSION OF THE RELEASEES INCLUDING RECKLESSNESS, ACTIVE OR PASSIVE NEGLIGENCE, OR OTHER FAULT OF THE RELEASEES, to the fullest extent permitted by law; (ii) WAIVE MY RIGHT TO SUE OR MAKE ANY DEMAND WHATSOEVER against any RELEASEE for any damages or losses arising, directly or indirectly, in connection with my participation in Move For Grady; (iii) AGREE NEVER TO SUE ANY RELEASEE asserting any claim for damages or losses suffered, directly or indirectly, in connection with my participation in Move For Grady; and (iv) AGREE TO INDEMNIFY AND HOLD EACH RELEASEE HARMLESS from any and all claims, demands, suits, damages, expenses, costs, liabilities, judgments, settlements and losses of any and every kind suffered or incurred by any RELEASEE and arising, directly or indirectly, in connection with my participation in Move For Grady. 
  13. I understand and agree that my name, photograph, voice or likeness to the extent obtained during or in connection with my participation in MOVE FOR GRADY may be used by the RELEASEES for any legitimate purpose, including but not limited to use on websites or in publications, displays, newspapers, magazines, advertisements, reports, videotapes, audiotapes and other media. I consent to and authorize, in advance, all such uses and waive all rights of privacy I have in connection therewith. I further understand that I will not be compensated for any such use. I also agree to release the RELEASEES from any and all liability arising out of or connected to the use of my name, photograph, voice or likeness as stated above. 
  14. Grady shall be excused from performance to the extent that it is prevented from performing as a result of delays or reasons caused by third parties or an act of God, war, civil disturbance, acts of terrorism, court order, labor dispute, pandemic, endemic, epidemic, or any other case beyond its reasonable control.  Any and all payments made to Grady are not refundable for any reason, including, without limitation, failure to participate due to illness, acts of God, war, civil disturbance, court order, labor dispute, pandemic, endemic, epidemic, travel-related issues, acts of terrorism, loss of employment, duplicate purchases, cancellation of the Move For Grady event, or any other case beyond its reasonable control. 
  15. I understand and agree that this Waiver, Release of Liability and Assumption of Risk Agreement inures to the express benefit of the RELEASEES and may be relied upon and enforced by any RELEASEE. I also understand and agree that the effectiveness of this Waiver, Release of Liability and Assumption of Risk shall indefinitely survive my participation in Move For Grady. 
  16. I understand and agree that if one or more provisions of this Waiver, Release of Liability and Assumption of Risk Agreement are held to be unenforceable under applicable law, such provision shall be excluded from this Waiver, Release of Liability and Assumption of Risk Agreement and the balance of the Waiver, Release of Liability and Assumption of Risk Agreement shall be interpreted as if such provisions were so excluded and shall be enforceable in accordance with its term. I understand and agree that the rights and remedies provided herein shall be cumulative and in addition to any other remedies available at law or in equity. I agree that this Waiver, Release of Liability and Assumption of Risk Agreement may not be modified or amended orally or in writing by any individual. 
  17. This Waiver, Release of Liability and Assumption of Risk Agreement shall be governed by the laws of the State of Georgia, without regard to its conflict of laws provisions and exclusive venue and jurisdiction for any litigation arising out of this Agreement shall be subject to the local, state or federal courts in Fulton County, Georgia. I agree that I will take no action to challenge the venue and jurisdiction agreed to in this section. 

I HAVE CAREFULLY READ THIS WAIVER, RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT AND ITS TERMS. BY CHECKING THE "I ACCEPT" BOX DURING THE ON-LINE REGISTRATION PROCESS, I AM KNOWINGLY AND VOLUNTARILY AGREEING TO ALL OF THE TERMS OF THIS WAIVER, RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT AND UNDERSTAND THAT BY AGREEING TO THESE TERMS I AM WAIVING SIGNIFICANT LEGAL RIGHTS.

PLEASE READ CAREFULLY - THIS IS A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS

For and in consideration of USA Cycling, Inc. (USAC) allowing me to become a member of USAC or to participate in any USAC-sanctioned, sponsored, licensed, or approved activity, including but not limited to races, rides, competitions, camps, clinics, practices, or incidental activities (individually and collectively, Event(s)) in any capacity (including as a rider, official, coach, mechanic, volunteer, spectator, contractor, or otherwise), and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, I agree as follows (and if the member/participant is under the age of 18 (19 in Alabama) (Minor Participant)), I agree to this USA Cycling Membership, Assumption of Risk, Release of Liability, Covenant Not to Sue, and Indemnification Agreement (Agreement) on behalf of myself and such Minor Participant as their parent or legal guardian):

  1. Rules, Regulations, and Policies. I agree to be bound and abide by USAC's bylaws, rules, regulations, and policies, including, without limitation, those contained in the USAC Rule Book, Safe Sport Program, Code of Conduct, and Bylaws adopted by USAC and as amended from time to time and published at www.usacycling.org. I further agree to be familiar with and abide by the rules and regulations established for an Event, to be familiar with the Event course, and to participate in a manner that neither endangers myself nor others. 
  2. Assumption of Risk. I am aware that cycling, cycling-related activities, or participation in an Event involve inherent risks, including but not limited to collision with pedestrians, vehicles, other participants, animals, and fixed or moving objects; participants of varying skill levels; Event conditions; course construction, layout, obstacles and conditions; surface hazards such as gravel or potholes; equipment failure; inadequate safety equipment; use of equipment or materials provided to me by others; those associated with manufactured and natural jumps; sickness or disease (including, without limitation, communicable disease); adverse weather conditions; situations beyond the immediate control of the Event organizers; and other undefined, not readily foreseeable and presently unknown risks and dangers. I fully understand that cycling is an extreme test of a person’s physical and mental limits, and my participation in an Event may involve the risk of serious injury (including, without limitation, broken bones, head, or neck injuries), trauma, pain and suffering, permanent disability, paralysis and death, economic loss, property damage or other loss that may result from my actions, inactions or negligence, and also from the actions, inactions or negligence of others including, without limitation, any Releasee (as defined in Section 3 below). I acknowledge and understand that the description of the risks listed above is incomplete and that the risks of participating in an Event may be dangerous, whether or not described. 
  3. Waiver and Release of Liability. I hereby forever release, waive, and discharge USAC; the USAC Foundation; the Union Cycliste Internationale (UCI); the United States Olympic and Paralympic Committee (USOPC); USAC Local Associations; USAC Clubs; USAC members; Event participants (including without limitation athletes/riders, coaches, officials, and other personnel); the Event owner, director, licensee, and competition managers; the promoters, sponsors, or advertisers of any Event; the owners, managers, or lessors of any facilities or premises where an Event may be held or who are otherwise connected with an Event; law enforcement agencies and local governments connected with an Event; and all directors, officers, agents, employees, volunteers, vendors, and insurance companies of any of the aforementioned parties (individually and collectively, “Releasees”) from any claims that may arise out of or are related to my participation in an Event, including without limitation claims arising from thenegligent acts or omissions of Releasees.  
  4. Indemnification. I agree to hold harmless, defend, and indemnify Releasees (that is to, without limitation, defend and pay any judgment and costs, including without limitation investigation costs, court costs, legal fees, and attorney’s fees) from any claims arising from my injury, death or loss due to my participation in an Event, including without limitation those arising from the risks assumed by me above in Section 2. I further agree to hold harmless, defend, and indemnify Releasees against any claims of others arising from my conduct, acts or omissions during my participation in an Event. 
  5. Covenant Not to SueI shall not sue or make any claim (or participate in any suit or claim) against any Releasees with respect to any released claim or any other matter addressed by this Agreement, including without limitation for injury, damage, death, or any other loss arising from or related to my participation in an Event. I understand that if I sue any Releasees, Releasees may seek to recover their costs from me, including without limitation legal fees.
  6. Health and Medical Treatment. I represent that I am healthy and in proper physical condition to participate safely in an Event. I acknowledge that it is my responsibility to make such a determination and that I am responsible for my well-being while participating in an Event. I consent to receive medical treatment deemed necessary if I am injured or require medical attention during my participation in an Event and to the release of my name and medical information by any third party to Releasees and their insurance carriers. I understand and agree that I am solely responsible for all costs related to such medical treatment. 
  7. Equipment. I accept responsibility for the condition and adequacy of my equipment and any equipment provided by others for my use. I shall wear a helmet that complies with USAC regulations and assume all responsibility for selecting such a helmet. 
  8. Anti-doping. I agree that I will comply with all anti-doping rules of the World Anti-Doping Agency (WADA), the UCI, the USOPC, including the USOPC National Anti-Doping Policy, and the U.S. Anti-Doping Agency (USADA), including the USADA Protocol for Olympic and Paralympic Movement Testing (USADA Protocol) and all other policies and rules adopted by WADA, the UCI, the USOPC, and USADA. I agree to submit to drug testing by the UCI and USADA or their designees at any time and understand that the use of methods or substances prohibited by the applicable anti-doping rules makes them subject to penalties including, but not limited to, disqualification and suspension. If it is determined that I may have committed a doping violation, I agree to submit to the results management authority and processes of USADA, including arbitration under the USADA Protocol, or to the results management authority of the UCI, if applicable or referred by USADA. 
  9. Use of Information. I understand that USAC may collect or receive my contact information in connection with this Agreement and use and share it to administer it, my membership in USAC, participation in Events, and marketing purposes. I further acknowledge, agree, and consent that (a) USAC and its designees may share this information with third parties who need access to this information to perform services on USAC’s behalf, (b) USAC may also share this information with select marketing partners, and (c) USAC and its select marketing partners may use this information to contact me with information and offers believed to be of interest to me. 
  10. Media Grant. I irrevocably grant and license to USAC, its affiliates and their respective designees the right to capture and use my image, likeness, name, voice, words, biographical information, or other proprietary or public rights or any other identifying characteristics, in any broadcast, telecast, photograph, video, or audio sound recording taken in connection with an Event, without compensation, notice or attribution, for any and all purposes, including without limitation any commercial use (so long as such commercial use does not imply my endorsement of any company, product or service), and in any and all media or manner, whether existing now or in the future. I understand that the foregoing prevents me from bringing any claims for such uses, including, without limitation, claims for invasion of privacy, defamation, or violation of publicity rights. 
  11. Arbitration. I agree that any dispute, claim, or cause of action regarding the terms of this Agreement, membership in USAC or participation in Events, or any related matters or activities, shall be resolved before a single, private, impartial arbitrator in a confidential, final, and binding individual arbitration held in El Paso County, Colorado, administered by the American Arbitration Association under its Commercial Arbitration Rules, and not in court. There is no judge or jury in arbitration and discovery and appellate options may be more limited than in court. The arbitrator shall apply Colorado substantive law without reference to Colorado's choice of law rules and shall have the power to award any remedies available under applicable law but, to the fullest extent allowed by applicable law, may not award relief to anyone but the individual claimant. Any award cannot be received as evidence in any other case except to enforce the award itself. If, for any reason, a dispute is deemed non-arbitrable, I agree not to pursue the dispute in court as a class or representative action unless applicable law precludes such waivers. This Section 11 is not a substitute for the administration of, or actions or proceedings under or with respect to, the foregoing rules and policies of the third-party organizations described in Section 8 above. 
  12. Governing Law; Jurisdiction. This Agreement shall be governed by and construed under the laws of Colorado without regard to its choice of law rules. Any legal suit, action, or proceeding arising out of or relating to this Agreement that are non-arbitrable shall be instituted in the state or federal courts located in Denver, Colorado, and each party irrevocably submits to the exclusive jurisdiction of such courts in any such suit, action, or proceeding. 
  13. Minor Participants. If I am accepting this Agreement on behalf of a Minor Participant, I represent that I am such Minor Participant’s parent or legal guardian, I agree, consent to, join in and approve this Agreement on my own behalf and on behalf of such Minor Participant, and I acknowledge and agree that I and the Minor Participant are bound by all the terms of this Agreement. By accepting this Agreement without a parent or legal guardian’s acceptance, I represent I am at least 18 years old (19 in Alabama). 
  14. Severability. If any provision of this Agreement is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision or invalidate or render unenforceable any other provision in any other jurisdiction, and such provision shall be modified in such instance to the extent reasonably necessary to make the provision valid, legal and enforceable. 
  15. Binding Effect. This Agreement shall be binding upon me and my respective successors, assignees, parents, legal guardians, subrogors, heirs, next of kin, legal and personal representatives, and anyone who obtains any rights from or through me. 
I have carefully read the preceding and understand its terms. I understand that I am giving up substantial rights, including my right to sue Releasees as set forth above. I acknowledge that I am signing this Agreement freely and voluntarily. I intend my electronic or handwritten signature to be a complete and unconditional release of all liability to the greatest extent permitted by law.

I, on behalf of myself and my heirs, assigns, personal representatives, administrators, estate and next of kin, HEREBY VOLUNTARILY, IRREVOCABLY AND FOREVER: (i) RELEASE Grady Memorial Hospital Corporation d/b/a Grady Health System, Grady Health Foundation, Georgia State University, Board of Regents of the University System of Georgia, each sponsor of Move For Grady, each funding partner of Move For Grady, each vendor providing goods or services to Move For Grady, each owner and/or lessor of any premises, property or piece of equipment used to conduct Move For Grady, each of the foregoing parties' respective affiliates, and each of the foregoing parties' respective current and former owners, partners, members, officers, directors, trustees, advisors, consultants, employees, agents, volunteers, officials, representatives, successors, assigns and other participants (collectively, "RELEASEES"), FROM ANY AND ALL LIABILITY WHATSOEVER, INCLUDING WITHOUT LIMITATION, LIABILITY FOR ANY AND ALL INJURIES, DISABILITIES, DEATH, LOSSES OR DAMAGES, INCLUDING PUNITIVE DAMAGES, TO PERSON OR PROPERTY, ARISING DIRECTLY OR INDIRECTLY IN CONNECTION WITH MY PARTICIPATION IN MOVE FOR GRADY, WHETHER OR NOT CAUSED BY ANY ACT OR OMISSION OF THE RELEASEES INCLUDING RECKLESSNESS, ACTIVE OR PASSIVE NEGLIGENCE, OR OTHER FAULT OF THE RELEASEES, to the fullest extent permitted by law; (ii) WAIVE MY RIGHT TO SUE OR MAKE ANY DEMAND WHATSOEVER against any RELEASEE for any damages or losses arising, directly or indirectly, in connection with my participation in Move For Grady; (iii) AGREE NEVER TO SUE ANY RELEASEE asserting any claim for damages or losses suffered, directly or indirectly, in connection with my participation in Move For Grady; and (iv) AGREE TO INDEMNIFY AND HOLD EACH RELEASEE HARMLESS from any and all claims, demands, suits, damages, expenses, costs, liabilities, judgments, settlements and losses of any and every kind suffered or incurred by any RELEASEE and arising, directly or indirectly, in connection with my participation in Move For Grady. 
  13. I understand and agree that my name, photograph, voice or likeness to the extent obtained during or in connection with my participation in MOVE FOR GRADY may be used by the RELEASEES for any legitimate purpose, including but not limited to use on websites or in publications, displays, newspapers, magazines, advertisements, reports, videotapes, audiotapes and other media. I consent to and authorize, in advance, all such uses and waive all rights of privacy I have in connection therewith. I further understand that I will not be compensated for any such use. I also agree to release the RELEASEES from any and all liability arising out of or connected to the use of my name, photograph, voice or likeness as stated above. 
  14. Grady shall be excused from performance to the extent that it is prevented from performing as a result of delays or reasons caused by third parties or an act of God, war, civil disturbance, acts of terrorism, court order, labor dispute, pandemic, endemic, epidemic, or any other case beyond its reasonable control.  Any and all payments made to Grady are not refundable for any reason, including, without limitation, failure to participate due to illness, acts of God, war, civil disturbance, court order, labor dispute, pandemic, endemic, epidemic, travel-related issues, acts of terrorism, loss of employment, duplicate purchases, cancellation of the Move For Grady event, or any other case beyond its reasonable control. 
  15. I understand and agree that this Waiver, Release of Liability and Assumption of Risk Agreement inures to the express benefit of the RELEASEES and may be relied upon and enforced by any RELEASEE. I also understand and agree that the effectiveness of this Waiver, Release of Liability and Assumption of Risk shall indefinitely survive my participation in Move For Grady. 
  16. I understand and agree that if one or more provisions of this Waiver, Release of Liability and Assumption of Risk Agreement are held to be unenforceable under applicable law, such provision shall be excluded from this Waiver, Release of Liability and Assumption of Risk Agreement and the balance of the Waiver, Release of Liability and Assumption of Risk Agreement shall be interpreted as if such provisions were so excluded and shall be enforceable in accordance with its term. I understand and agree that the rights and remedies provided herein shall be cumulative and in addition to any other remedies available at law or in equity. I agree that this Waiver, Release of Liability and Assumption of Risk Agreement may not be modified or amended orally or in writing by any individual. 
  17. This Waiver, Release of Liability and Assumption of Risk Agreement shall be governed by the laws of the State of Georgia, without regard to its conflict of laws provisions and exclusive venue and jurisdiction for any litigation arising out of this Agreement shall be subject to the local, state or federal courts in Fulton County, Georgia. I agree that I will take no action to challenge the venue and jurisdiction agreed to in this section. 

I HAVE CAREFULLY READ THIS WAIVER, RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT AND ITS TERMS. BY CHECKING THE "I ACCEPT" BOX DURING THE ON-LINE REGISTRATION PROCESS, I AM KNOWINGLY AND VOLUNTARILY AGREEING TO ALL OF THE TERMS OF THIS WAIVER, RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT AND UNDERSTAND THAT BY AGREEING TO THESE TERMS I AM WAIVING SIGNIFICANT LEGAL RIGHTS.

PARTICIPANT WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

For and in consideration of USA Track & Field, Inc. (“USA Track & Field” or “USATF”) allowing me, the registrant, to participate in the USA Track & Field sanctioned event I am registering for herein (the “Event” or “Events”); I, for myself, and on behalf of my spouse, children, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns, hereby agree to and make the following contractual representations pursuant to this Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement (the “Agreement”); 

1. I hereby represent that (i) I am at least eighteen (18) years of age (or this Agreement is also agreed to by my parent, natural guardian, or legal guardian (the “Guardian”)); (ii) I am in good health and in proper physical condition to participate in the Event; and (iii) I am not under the influence of alcohol or any illicit or prescription drugs which would in any way impair my ability to safely participate in the Event. I agree that it is my sole responsibility to determine whether I am sufficiently fit and healthy enough to participate in the Event, that I am responsible for my own safety and well-being at all times and under all circumstances while at the Event site. 

2. I understand and acknowledge that participation in track & field, road running, race walking, cross country, mountain, ultra, and trail running Events is inherently dangerous and represents an extreme test of a person’s physical and mental limits. I understand and acknowledge the risks and dangers associated with participation in the Event and sports of track & field and related activities, including without limitation, the potential for serious bodily injury, sickness and disease (including communicable disease), permanent disability, paralysis and loss of life; loss of or damage to equipment/property; exposure to extreme conditions and circumstances; contact with other participants, spectators, animals or other natural or manmade objects; dangers arising from adverse weather conditions; imperfect course or track conditions; land, water and surface hazards; equipment failure; inadequate safety measures; participants of varying skill levels; situations beyond the immediate control of the Event Organizers (as defined in Section 4 below); and other undefined, not readily foreseeable and presently unknown risks and dangers (“Risks”). I understand that these Risks may be caused in whole or in part by my own actions or inactions or the actions or inactions of others participating in or organizing the Event, and I hereby expressly assume all such Risks and responsibility for any damages, liabilities, losses or expenses which I incur as a result of my participation in any Event, except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties (as defined in Section 4 below). 

3. I agree to be familiar with and to abide by the Rules and Regulations established for the Event, including but not limited to the Competition Rules adopted by USA Track & Field and any safety regulations established for the benefit of all participants. I accept sole responsibility for my own conduct and actions while participating in the Event, and the condition and adequacy of my equipment. 

4. I hereby release, waive and covenant not to sue, and further agree to indemnify, defend and hold harmless the following parties, as relevant and applicable in each instance: USATF, its members, clubs, associations, sport disciplines and divisions; United States Olympic Committee (USOC); the event directors, the host organization and the facility, venue and property owners or operators upon which the Event takes place; and any other organizers, promoters, sponsors, advertisers, coaches and officials for this Event; law enforcement agencies and other public entities providing support for the Event; and each of their respective parent, subsidiary and affiliated companies, officers, directors, partners, shareholders, members, agents, employees and volunteers (Individually and collectively, the “Released Parties” or “Event Organizers”), with respect to any liability, claim(s), demand(s), cause(s) of action, damage(s), loss or expense (including court costs and attorneys’ fees) of any kind or nature (“Liability”) which may arise out of, result from, or relate in any way to my participation in the Event, except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties. I further agree that if, despite this Agreement, I, or anyone on my behalf, makes a claim for Liability against any of the Released Parties, I will indemnify, defend and hold harmless each of the Released Parties from any such Liabilities which may be incurred as the result of such claim, except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties, as relevant and applicable in each instance. 

5. As a condition of my participation in the Event, I hereby grant USA Track & Field, the event director and host organization a limited license to use my name, likeness, image, photograph, voice, video, athletic performance, biographical and other information (collectively, “Likeness”), in any media platform or format whatsoever, and to distribute, broadcast and exhibit these without charge, restriction or liability, but only for the purposes of advertising or promoting the Event, USATF, or the sport of Athletics. The foregoing grant, however, does not constitute consent for USATF or any third party to use my Likeness in an endorsement of any product or service without my specific written consent. 

I hereby warrant that I (or the Guardian, if I am under the age of 18) am of legal age and competent to enter into this Agreement, that I have read this Agreement carefully, understand its terms and conditions, acknowledge that I will be giving up substantial legal rights by accepting it (including the rights of my spouse, children, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns), acknowledge that I have accepted this Agreement without any inducement, assurance or guarantee, and intend for my acceptance to serve as confirmation of my complete and unconditional acceptance of the terms, conditions and provisions of this Agreement. This Agreement represents the complete understanding between the parties regarding these issues and no oral representations, statements or inducements have been made apart from this Agreement. If any provision of this Agreement is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. 

If the participant is under the age of 18, the Guardian hereby agrees to release and discharge the Released Parties as follows: a) The Guardian acknowledges and understands that the Event is inherently dangerous and represents an extreme test of a person’s physical and mental limits. Further, the Guardian acknowledges and understands the Risks, as defined above. b) The Guardian acknowledges the rights waived by both the Guardian and the participant by accepting this Agreement. c) The Guardian acknowledges that the Guardian will indemnify the Released Parties from any and all Liability which may arise out of, result from, or relate in any way to the participant’s participation in the Event, except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties.
